North Dakota defines the three classes at NDCC § 39-01-01 and regulates them at § 39-10.1-09, with no license, registration or insurance required. There is no statewide minimum riding age. The helmet rule is narrow but specific: a rider under 18 may not operate a Class 3 unless wearing a safety helmet; there is no helmet requirement for Class 1 or Class 2 at any age. Class 3 eBikes must have a working speedometer. Path access is unusually open — the statute allows an eBike of any class on any bicycle path or multi-use path unless the governmental entity with jurisdiction prohibits it. North Dakota also allows the multi-lane version of the "Idaho stop" for bicycles.
