West Virginia adopted the three-class framework through HB 2062 (2023), codified at W. Va. Code § 17C-11-8. eBikes are treated as bicycles, so no license, registration or insurance is required. A rider must be 16 to operate a Class 3. Under the Child Bicycle Safety Act provision at § 17C-11-8(i)(2), any operator or passenger under 15 must wear a properly fitted helmet on any class of eBike; there is no helmet requirement for adults. Rail-trail access is the practical question in West Virginia — the Greenbrier River Trail, the North Bend Rail Trail and New River Gorge National Park each publish their own eBike policies, and some local systems restrict throttle-equipped bikes.
