South Dakota codified the three classes in SDCL chapter 32-20B, capping qualifying eBikes at 750 watts and exempting them from license, registration and insurance requirements. Section 32-20B-13 sets the Class 3 minimum operating age at 16. The helmet rule at § 32-20B-14 is unusual: a Class 3 operator under 18 must wear a helmet, and so must every Class 3 passenger of any age. Class 3 eBikes must be equipped with a speedometer (§ 32-20B-15) and are not permitted on bicycle paths or multi-use paths. Black Hills trail systems and state parks set their own policies for Class 1 and 2 access on natural-surface trails.
