New York's version of the three-class system has two quirks worth knowing. First, a Class 3 in New York tops out at 25 mph, not 28. Second, Class 3 eBikes are only legal in cities with a population of one million or more — in practice, New York City alone. Statewide, you must be at least 16 to operate any eBike; helmets are required for operators aged 16 and 17 on any class, and for every operator and passenger on a Class 3 regardless of age (VTL § 1238). No license, registration or insurance is required. Inside New York City, the Department of Transportation now caps all eBikes at 15 mph on city streets, and city parks have their own restrictions. New York also enforces battery-certification requirements on sellers, which the Attorney General has reminded retailers about in 2026.
