New Mexico recognizes the three classes and treats compliant eBikes as bicycles — no driver's license, registration, title or insurance. Under NMSA § 66-3-707 every rider and passenger under 18 must wear a properly fitted helmet meeting CPSC, ANSI, Snell or ASTM standards on any public road, sidewalk, bicycle path or trail; that applies to conventional bicycles too. The minimum age to operate a Class 3 is 16. Path access is tighter here than in many states: § 66-3-709 lets Class 1 use paths, bike routes and park paths open to bicycles unless a local ordinance says otherwise, but Class 2 and Class 3 are not allowed on bicycle or pedestrian paths unless the path is within a street or highway or a local ordinance permits it.
