Delaware's eBike rules live in Title 21, Chapter 41 of the Delaware Code. All three classes are recognized: Class 1 and Class 2 cut off at 20 mph and Class 3 at 28 mph, with Class 3 required to carry a speedometer. Riders must be at least 16 to operate a Class 3, though younger riders may ride as passengers on a bike built for them. Helmets are required for every Class 3 operator and passenger regardless of age, and for anyone under 18 on a Class 1 or Class 2. No license, registration or insurance is required. Coastal towns in Sussex County set their own boardwalk and path rules seasonally, so check posted signs at the beach towns.
