California wrote the template most states copied, and it has also been the most active state in tightening the rules. Class 1 and Class 2 eBikes may use bike paths and multi-use trails unless a local agency says otherwise; Class 3 is restricted to roadways and bike lanes and is not allowed on Class I bike paths unless a local authority opens them. Everyone under 18 must wear a helmet on any class, and every Class 3 rider and passenger must wear one regardless of age; you must be 16 to operate a Class 3. Two newer laws matter when you shop: AB 1774 bans selling devices that modify an eBike beyond its class, and SB 1271 — in force since January 1, 2026 — requires eBikes, batteries and chargers sold, leased or rented in California to be certified to an accredited standard such as UL 2849 or EN 15194 and labeled accordingly. eBikes still need no license, registration or insurance. Note that the statewide purchase incentive is no longer accepting applications.
